Guys,
Can someone please let me know whether it is possible / advisable to travel while H1 approval is pending?
She is currently in H4 with a valid stamp in her passport. She filed for her H1 and was selected in lottery. She has a receipt but her approval is pending.
We were interested in making a short trip to India before Oct 1. But the consulting firm advised against it as according to them if she re-enters in H4 (even before Oct 1) while her H1 approval is pending, her H1 application will be cancelled and she has to restart the process all over again. Something to do with the last status on re-entry.
My thoughts are: The change of status will be effective Oct 1, 2008, why would it matter if I travel prior to that date?
A lot of you may have experienced the same dilemma, so please let me know...

Looks like your application which was sent on Jul -2nd now carries a received date of July 30 (as they got to the app around that day). Please provide some more details about your case

I filed I-485 on October 1st. Alone with I-485 I filed Form G-1145, E-Notification of Application/Petition Acceptance. Instructions for G-1145 says that I will be notified within 24 hours of documents accepting but I didn't get any notification yet. Is this something I should worry about? Documents been sent by Express mail and delivered to Chicago lockbox on October 1st.

Have you filed your 485 during july fiasco, if yes then you have 180 days + after your 485 filed and you can move/port to any other employer
I have these below queries on Green card processing
My Green card processing background

The reason for these questions is that I am planning to change the company that I am working with.

have a couple of quick questions. It would be great if someone could
answer them for me.
(1) Do I need to leave my I-94 card in when I give them my
old passport? Is it OK if I remove it? Do they make a big deal of this?
(2) In the online form, what do I choose for the "Service Desired" field?

I had similar situation few years back after my I-140 approved, but before applying I-485.
As long as your job title, description and place of work won't change, then you are ok. When you apply I485 or H1B ext, then your attorney must submit a document (successor of interest or similar document), telling that your role and place don't change.

I want to apply for Green Card in EB2 Category through my employee. But I already have a green card in process via my spouse's employee in EB3 Category.
1. So will I be able to get the priority date of the green card process which is in EB3 Category? -- NO

Use a good lawyer who can help with interpretation. USCIS has been flexible about the "same or similar" job thing , unless the jobs are entirely in a different occupation.

My H1B extension is pending with the VSC. I want to upgrade my H1B extension to a premium process by paying 1000 USD.
Now, my question is - Can I do it myself thru efile or regular way using form I-907? Or should it be done only thru the employer or attorney?
I am asking this because my attorney is charging a ridiculous attorney fees of 250 USD on top of 1000 USD for upgrading my case to a premium!
Please help.

Hi All,
First of all Congrats! to all people who are eligible to file 485 in july..
i have strage problem..i am not weather its a problem or not..i have filed my GC in 2004 December and you all know that after that the BEC process came in every thing went to BEC's..and i had no hope on that file and i asked my employer to process my GC under PERM process in 2006 april and i got the Labor and I-140 approved in 6 months...and mean while i got the 2004 labor approved in Feb 2007 and asked my employer which one will be the best and he recommended me apply for I-140 for 2004 labor and wait untill the dates become current and he was expecting the 2004 will become current...so we have applied for I-140 for 2004 labor on May 1st 2007 and the status is pending...now my questios is..
1) Is there is any problem if i use the 2004 labor and apply for I-485.
2) When attorney file for I-140 did they mention any where in that forms that i do not have any immigration petiton has been submited before?
3) If they mention no (miss communication) and applied for I-140 for 2004 labor but in fact there is a petition (I-140) submited for me for my 2006 labor.will this be a problem for my 485 approval?
4) which one will be the best for me to use now 2004 or 2006?

MSNBC had a news piece on surprise illegal immigrants and looks like they are from India. I was surprised at a shocking 125,000 people have over stayed their visas and have become Illegal. I was worried if such news articles will reflect on our integrity and our image as knowledge workers.

If it's strictly on "first received, first processed" base, then it may well be that one guy with 3/07 PD date may have his application processed earlier (thus earlier AP and EAD) than one with 5/06 PD date. Simply because the 3/07 PD guy sent out the package much earlier than the 5/06 PD one.
Do I understand correctly?

Thanks for the suggestions. I called in the National Service Center and put in a request to expedite the case. Got an email that I can try to visit the local ASC and see if they can collect the biometric. We visited the local ASC today and the were kind enough to collect the Biometric. I hope we get the AP before the departure date..
