Hello All,
My wife is in a similar situation where she was on F1 till Sept 31st (OPT) and now on H1-B (since Oct 1st). I have also added her as a dependent in my GC application and hence she has received her AP. We are planning to go to India in the month of January. Can she return back using AP? I have read in other threads that one can return using AP and there is no need to stamp your H1-B visa in the passport. But in her case, the H1-B visa is not stamped even once. Can this be a problem if she enters using AP? I would appreciate your advise in this matter.

I don't think leave of absence nullify employer employee relationship. I checked this with my HR too when I was waiting for my EAD to be renewed. HR clearly told me that the only option was to terminate my employment in case my EAD was not renewed in time, and they would have opened the position and rehire me after receiving the physical EAD.

Hi All,
Please help me to take proper decision.
I am working in US on H1B visa and my employer is ready to file for my GC in EB2.
Secondly, my father is a Green card holder and can apply for citizenship in early 2010. I have following questions:
Please note I am unmarried
1. If my father applies for GC for me under F2B can it be converted to F1 when he becomes citizen? if so, will the priority date be same or it will be new once converted to F1 category.
2. Can I apply for both family based and employment based in parallel? if it is not possible which path should I select? Will the employment based GC will be faster of family based? Its tough to decide in this economic times as we dont know how long our job will last.
Would appreciate your help and suggessions.

Hi I have H1 papers from my last extension valid until June 15.
I haven't traveled during this period but planning to visit India Between March20 and April 20. So I will have to visit US embassy for stamping.
Can someone please let me know the risk associated with going for stamping with H1 only valid for 2 months.
I am applying for an extension but I will not receive the extension papers until May and do not want to wait until then as this will be my last extension until Dec.
Please advice if its safe to go to US consulate in India for stamping with only 2 months validity on my H1.

It is stating the obvious to say that blogs have been playing an ever important role in creating awareness of issues and shaping public opinion; yet we've not had a good representation of our issues in the blogosphere.
The flower campaign got a lot of attention in mainstream media but we did not have a good co-ordinated effort going on in the blogging community.
As we go forward, I think we should have a communication medium so that all the bloggers interested in these issues can discuss and execute strategies.
So if you are a blogger or are interested in becoming one, please join this Google group. Hopefully for future campaigns like rallies etc. we will be able to create more awareness in the blogging community.

My H1B was expired on DEC11,2009.My employer applied H1B extension in Oct 2009, i'm still waiting for Approval notice. since my I-94 expired on DEC11,2009. what is my status untill i get my H1b extension? will i be in leagal status until i get the H1 approval?
I have EAD with the same employer but not using.
Is anybody in the same situation?

Since you applied for extension before your current H1 expired, you are allowed to continue to work for 240 days from the date of H1 expiry. If your H1 is still not approved, then I believe you will have to stop working but can still be in the country till a decision has been made on your petition. Your employer could try and upgrade your pending application to premium processing so you will get to hear from USCIS within 15 days.

Looks like the long awaited spending bill is finally in the making and should make its way to the congress soon. For those of you who haven't contributed to IV, this should come as a warning that if you don't contribute now, it may just be too late for us to seek any relief in these bills.
Once this opportunity has passed, we'll be stuck with CIR which everyone knows is a tough pill to swallow for either party in the congress and could drag on for months and may never see the light of the day. So here are the choices:
1. Contribute now and try to get some relief from these spending bills.
2. Contribute later and try to get something done with CIR/SKIL.
3. Never contribute and just watch core members pull their hair trying to figure out why people are not contributing and just hope that GC will fall from sky.
Whatever you chose to do, please think twice before you make up your mind.

"You can actually get things expunged but I've been pretty busy. So I was detained, I was interrogated. It was a blast.

While I certainly feel somewhat bad for Mr. Downey, this short exchange gave the impression that nothing similar would ever happen in America! Hah!
U.S. Immigration Law contains restrictions that bar entry to people forever, for virtually any youthful indiscretion they have ever had, e.g. simple possession of a marijuana 20 years ago, without regard to whether or not you were actually convicted of the crime! You do not even need to have been convicted; the fact that you admit you did it will also get you barred from entry. Heck you will even be bounced (http://www.markshuttleworth.com/archives/43) from the United States after overstaying your visa for one day, leaving one day late, and then trying to come back in on that visa. Please help me with my situation below:
1) Got laid off from company A (they haven't cancelled my H1).
2) Got my H1B transferred to company B (this H1B transfer has not yet been approved). I did not work for them.
3) I did premium processing for H1B transfer for company C and got it approved. I haven't started working for them.
4) Now I have decided to work for company D. They are ready to do my H1B transfer.
Will that be a problem or do I have to go with company C? I do not have paystubs from company B and C. If I have to reenter US, will that be a problem? Please help me out.
file it immediately and start working for C. If there is an RFE, it'd take few months by that time you just send ur current pay stubs. INS is generally flexible for a month or so..act fast

My wife's AP was sent out on NOV13th according to online status and we didnt receive it till now and I called the USCIS today and the rep we didnt receive it back as undelivereable & once its once out of our office its not their concern & told re-applying is the only option.
Issue?: My wife went to INDIA and she is on L1 and I was wondering when I re-apply her AP here, can she enter while her AP is pending approval ?

What are our options, please advise.
