I suppose you are doing consular processing? Right? Well, when the consulate is aware that your PD is about to be current, and if all other tasks are completed, they should send you packet 60-90 days in advance of your interview.

This is to complicated and INS take a lot of time to respond....By the way do you know aproximately how long will take to receive the I-140 approval? And if there is a chance to receive a DENIED notice? I'm so wooried about all this process and alo because I don't have the best attorney in th all world, and sometimes I don't know what to do...I'm learning a lot fom this forums. Thanks Again....

Based on the predictions for the November 7th 2006 elections for the House, looks like the democrats will grab a considerable amount of seats,
viz - Democrats - around 228, Republicans - 205
What do you guys think based on this? I hope starting from January 2007, there should be some light.
Thinking ahead, We should work with the democrats, rather than republicans. Citizens of US, who immigrated from India should vote for Democrats and make them win this elections.

Hello All,
Following is my situation:
1) Recently got my L1 extension approval through company A which is valid through Aug, 2010.
2) I also have a Consular-H1B petition papers from same company A which is valid till Aug,
2011. But i don't have H1B visa stamp in my passport.
*My question is:
Is it possible to do H1B petition transfer from Company A to Company B without COS from L1 to H1?
OR
Should I first apply COS from L1->H1 through company A and then apply for H1B transfer from Company A to company B.
(and I believe for COS to happen i need to be still employed with company A.)
I am not planning to go India now but wanted to apply H1 transfer and work for the new company B in case of my layoff from present company A

Is the postal address same for EAD & AP renewal for e-Filers.
The forms that printed out for EAD & AP renewal for e-Filers shows same address to send the supporting documents.
And only EAD needs the 2 photos right not the AP for e-Filers.

One of my friend is ready to apply for 485. He is all set.
The problem is he got recently married and his wife's passport and other details are not yet ready and she is still in India.
Can he still submit his 485 for his wife?

Let us be very clear, we are MORE THAN WILLING to associate with any org that can be beneficial to us. One of the members of IV had established contact with USINPAC and it has been a very fruitful association
If anyone can do the same thing with any other org (could be 'Chinese Physicians Association', or 'Russians in America' or 'Canadians in USA' or even 'Americans for High Skilled Immigrants' - please note that I made up all the names, but please get the gist) please take the inititative and let us know how it goes.
Also note, that even if we associate with an org primarily working for a particular country, all our issues will benefit EVERYONE from every country. It is impossible to press for an amendment like 'Ability to file I485 without regard to visa number for Indian Nationals only'. The US Government doesn't allow that and neither will IV go in that direction.
The keywords here are 'publicity and exposure'. We really need that to protect our amendments in the Senate and the House Conference

Now is this for a RFE where a notarized copy is specifically asked ?
My dad just scanned my BC and e-mailed it and I took a print out of that and sent it for the I-485. (No RFE)
Why do you need the originals ? There is no requirement to get it notarized as well.

In OHIO I have successfully renewed my DL for 4 full years solely on original I-485 receipt.
On H1 they still give 1 year extensions.

Any word on when PP for I-140 will come to life?
USCIS said PP is suspended till 8/1 and later will analyze the situation to bring it back. The analysis is talking more than a month. It is known that they have been busy people this past month. Is the I-140 application flood effecting their analysis?

View the attached thumbnail (click on it for fullversion) to see how a slight change in the position of the elements could affect the photograph (the "ZING" as Lecter calls it ;)).
You did, however, pick a good time of day for your photo. Too early and the plane might be even darker with no detail, and too late and the moon would have to be overexposed if you wanted the rest of the picture to look like it does now.

Your I - 94 Validity cannot be at a date later than H1-B. You say you got your first H1B visa till Oct 2005, but I - 94 expires in Nov 2005. I donot think it can happen
Third country Nationals can go to Mexico and get thier Visa stamped. The only thing is if your Visa gets refused for some reason, you will have to fly back to home coutry and get it stamped.
Have not heard such cases though.

Yes, this should be possible assuming your priority date is still backlogged. If not, you can at least get the unused part of your 6 years.
2.Can I claim the remaining time on my H1B approval(based on I-140) with company XYZ ? I have copy of the H1B approval but not sure if it has been revoked.
