Hi all,
My current H1B I-797 will expire in Sep. 30th. My company is in process of filing a 3yr extension, but they are still in the 10-day job posting period, so the attorney will not probably file until mid-Sep. Hopefully with Premium processing it might get approved before the end of Sep.
My question: My latest H1B visa stamp was issued for 1 year (county-limit), and expires on Oct-17. Due to admin processing, it took almost 5 months to renew it last time. If i have the approval 797, and go to renew my visa either at home consulate, or in Canada, what would happen? A. Would they renew the visa without doing any new sec. checks or admin processing? B. Would they cancel my current visa if they put my new one on admin processing? C. Else?
The purpose is just to have a renewed H1B before my current one expires, if this will be any advantage.
Please advice.

Yes, you can port your EB3 priority date to EB2, even if the sponsor is not the same.

I have started a new thread to remind everyone (who has not yet contributed) to contribute for the just concluded Advocacy day.
Take some funds from any money that you put aside this year for charitable causes or temple donations. I recently found a new job and they filed for my H1 transfer in premium processing. I am still working for my old employer. Now I have got an RFE questioning why my salary (in 2009 W2) which is less than what was mentioned in my previous petition. Even though I have all my paystubs I was on bench for few months between march - may 2009. I have a leave letter for 4 weeks vacation in may and my salary was reduced when I got new project. Which explains why it is less but may not be enough to prove it to USCIS. Salary in W2 could also be less that prevailing wage. Right now I have following scenarios
1. WIthdraw application - not sure repurcussion of this.
2. Respond to RFE with mentioned reason which can have following outcomes
a) Appoved - (good i will be more than happy)
b) Approved with consular processing - (I dont want to travel at this point of time outside US)
c) denied - (not sure)
3. This case goes to DOL and there may be investigation or indent of revoke sent to my employer. Can this happen?
Here are my questions
1. Senario 2.b. If I get "Approved with consular processing" do I have to travel to India for stamping immediately or just get new I94? What will be my current status then? What if I decide not to join the new employer?
2. Senario 2.c. If I get "Denied" what will be my current status?
3. What should I do so that I am not out of status and I dont have to travel to India for stamping?
4. Scenario 3, Can this happen?
Any response will be appreciated. Thanks!

Myself and my wife are both on H1-b. Our 485 was applied in Jul 07. I have to apply for EAD by myself. Can I apply for EAD now and then apply for AP(I-131) at a later time ?

Just make the switch,,thats it! Its that simple!! Make sure when u join the new company they file your perm asap and when u r in the 140 stage, you could work with your lawyer to port your old PD. AC21 has made life better!
There are two ways :-
a) Get your H1 transferred and join a new company. You need to complete your new PERM and I-140 before Mar'08 to get your next extension. In this case, you cannot carry over your PD.
b) Wait for your I-140 to be approved. Once it is there, move on, and file your PERM/I-140. You should be able to get your next extension based on the approved I-140 unless it is revoked. Also, you can start your PERM in parallel while waiting for I-140. You can speed up your I-140 by moving it to PREMIUM processing - it involves another 1000 $ of cost. This way you can carry on your PD if you can get a copy of the I-140 when you leave.
There would be other ways too - folks here can enlighten you on the same and if there are any corrections in what I suggested you, they would gladly do it.

my Advance Parole for this purpose. When I come back (to avoid h1b stamping again in home country). Do I need to use EAD to continue

Some people are getting an I-94, which will be valid for an year from date of entry!. Does that mean her parole status expires after one year of re-entry. If so, what should I do to extend it?

yes, I have done that. I had visa stamp of Company A and I was working for Company B. please note that the visa stamp of Company A was not expired when I entered US port of entry. At port of entry, I showed the H1 approval notice of new employer. Please make sure that they stamp the expiry date in your I-94 based on your new approval notice of Company B. that is very important.

You should only disclose class B misdemeanors and up. I would think that your citations are class C misdemeanors, which are same as traffic violations. I don't think you are required to disclose those, unless you got arrested, taken to court, etc. Just my opinion.
