Hi,
Need advice from an attorney:
My I-94 expires in december 2010. I have an approved Advance parole till Dec 2011(I485 is pending). Is it required to travel outside the country and get a new I-94 ?
2. Is there a source on the Net that I can refer to that explains this?

You don't have to travel outside. it is still legal to stay in the country.

I have traveled by Emirates several times (last year was the recent one) and they did NOT require a transit visa.

I have a question. Our files are stuck in the Chicago local office (after our interview last year) and the only thing pending is the Namecheck, which has been pending for more than 180 days. Our PD is current. Is anyone in the same position?
It is frustrating because you do not get any LUDs when your files are in the local office and I have no indication whether the Chicago officeis processing cases with NC pending > 180 days. Anyone knows?
You should send a letter to local office and demand adjudication. Attach Feb 4th memo.

I'm off to London for my H1B stamping. I was working for an Investment Bank that folded and I took up a job with a bank that has not taken TARP funds (not a US bank)
My I-129 was approved, however, it was approved before the new I-129 that asks whether the company accessed covered funds.
I just wanted to know whether I need to ask counsel in my firm to update the I-129 or should I just go ahead with the stamping?
Any other important documents I should take along? I was thinking of
a) letter from employer stating salary, start-date, position etc
b) letter from company stating that they did not receive TARP
anyone else on the same boat?

I have my I-140 approved. My wife is filling I-539 form for extension of stay. I just want to make sure from you guys, in the form where it says 'Are you an applicant of an immigrant visa' she has to say 'No'. As I am guessing until I-485 is filed, our answer to this question is always 'No'.

- H1B is good as long as employer-employee relationship is maintained, which in your case should be fine
- You may have issues with 140 approval (Just my opinion, I may be wrong)
- If you are considering H1 transfer, that may have issues as you may not have latest paycheck..

My 6th year of H1b is expiring in the Sep 26, 2008. I already applied for my H1b renewal and already got the receipt. I'm Eb3 - ROW.
My and my wife also applied for our EAD renewal in jun 1, 2008 (Nabraska). didn't receive anything till now. My wife needs that to continue with her job, we already expedite the process last week.
I also visited home couple of months and and entered Us using my AP.
I have some question regarding all those issues:
1) Can I get a business license when i'm working with the H1b and have the EAD?
2) Does it going to have any effect on my green card process or H1b status?
3) If i have the problem then can i open the business license under my wife's name as she will be in the EAD.
4) My PD is May 2006. Any chance it will be current in next 6 months?

Hi gurus,
I have been working with employer A since last 3 years. My I-140 (EB3)has been filed on April 1, 2008 and my priority date is January 9, 2008. I am planning on changing jobs within the same company but in a different state / city.
1)Would this affect my I-140 processing
2) Would this create any issues in the future stages of the green card process
3)Will I still be able to keep the same priority date for the I-485 (God knows when I'll get to that stage...)

2. Which center is doing PERM faster?

I know that PERM labor gets expired if one does not file I-140 within 180 days of labor's approval date.
I am wondering if DOL has any procedure to revive expired approved/unused PERM by filing some sort of request/appeal or by paying some sort of fees etc. or if not ,then one files a new PERM by referring the old unused approved labor for the same job and same person then DOL can give an expedited approval.

Department of Homeland Security (DHS) and Department of Defense (DOD) today announced that National Guard deployments to the Southwest border will begin on Aug. 1 as part of the administration�s unprecedented efforts to combat the transnational criminal organizations that smuggle weapons, cash and people across our Southwest border. Aliens who married or had children before the date of obtaining permanent residency can possibly confer �following-to-join� benefits to their family members. Due to this process, spouses and children will be able to receive green cards quickly. �Following-to join� is not family based immigration, but is similar to a child/spouse receiving derivative benefits based on a primary LPR�s immigration petition.
Here are the following requirements to be met in order for a spouse or child to qualify under �following-to-join�:
1. The LPR must have adjusted status or obtained an immigrant visa through a preference category (family or employment based) or diversity lottery. A LPR�s visa number must also be current in order for a family member to receive �following-to-join�.
2. The petitioner married/had children before becoming a permanent resident and the relationship between the permanent resident and spouse/child is intact at the time of filing. Children of LPRs must be unmarried and under the age of 21. Furthermore, the child/step-child must be from an existing marriage before the LPR obtained permanent residency.
�Following-to-join� is convenient because it allows primary beneficiaries to do away with filing a separate I-130 for their spouse or child, greatly expediting the green card approval process. Furthermore, spouses and children of LPRs do not have to wait for a visa number to become available. Where a LPR�s spouse or child currently resides affects what procedures he/she needs to follow.
