Hi ,
I want to change my wife's H1 to H4.
She got her first approval in oct 2006 and was working as fulltime. after that she coverted to H4 when we visited india. her H4 is valid through oct'09. then we file for her new H1 from company B in march 09 (COS) and she got approval but due to bad market condition she never got project and her consulting company never paid her so she doesn't have any paystubs. My company file for my H1B extension and I got approval.
Now I want to change my wife's status back to h4. I had in impression that she never worked on new H1 so her H1 will not be activated. but I came across some posts and learn that it is automatically activated the day she got her H1B approval.
Now please suggest me what would be the safest way to convert her back on H4 ?
1)File form I-539 without her paystubs using my new 797 document? is there chances of RFE without paystubs? and what could be the next step if RFE comes? can we go to home country and get it done or it will make more complications? and VO will ask more questions because of RFE?
2) go out of county and come back again on existing stammped h4 (I am hoping that will convert her status back to H4)? and then file for I-539 for H4 extension using my new Approval notice? she has canadian PR as well. should she visit canada or india? somehow her I94 on passport has expired in Feb'09 but she has valid I94 on her H1 pitition. should she give her new I94 when going out of country? if she visits canada will they issue her new I94 if she returns back within 30 days?
3) should she go outside country and apply for new H4 using my new approved 797 ?

--Is the image worth capturing, i.e., does it have enough photographic value to be worth the trouble?
--What would you do to improve composition?
--How would you crop it differently?
--Would you have done something different in post-processing?
--What is your honest opinion of the image?

If not EB1, even EB2 is fine because you belong to UK and EB2 is current for you. If you claim EB1, you can easily apply in EB2 and it's "current" for you.

Yes you can go to school part time on H1 for MBA. Some states allow you to claim in state tuition on H1 for state schools - that will significantly reduce the tuition bill. In addition Federal govt allows either a deduction of $4k / yr or a credit of up to $2 k / yr (search for tuition tax deduction and Lifetime Learning credits).

i think at re-entry for the 485 pending /AP applicants, there is a POSSIBILITY that the officers could question you bout ur existing employment. For such cases people r adviced to carry the current employers letter along with copy of 485 receipt for safety sake.
with that in mind, if all possible, using ur EAD(after that 180 day rule) , get a job may be collect a paystub or 2 , get a letter and then use the AP.
in many other forums, pple have shared info such as "officer asked me if im still employed with the same employer who filed for GC." etc etc . its better to carry something atleast to prove that when asked.

option 3 as far as I know. You only renew the 6 year term if you are out of the US more than a year. And once you switch to a different visa category, your previous one does not matter for the cap. Its only if you are transferring from an existing H1B or renewing an existing H1B that the cap doesn't come into the picture.

I was wondering how the engine is calculating the scaling of the image to change the ViewPort, while zooming in and out. Does the change of ViewPort and the image composition within it depends only on the viewport width?
I have not able to find much greater details on this yet from MS. Would you be able to direct me please to some materials to understand more on Multiscale image control and its working in and out.

it's more Marketing rubbish..
certainly it'll be a better 6MP image than before, but it won't have the pure resolution of a 1Ds or 14N.
Dynamic Range will be nice, but doesn't tip it over the edge. Why don't they go bigger in MP? One might ask.... I think they're finding it tough.. Somehow Canon has nailed it. Kodak couldn't.
Interesting times ahead!!

Just hold on to those papers and make them available when they travel back in future.
Their Visa will not get cancelled, i have seen people coming back second time after just rejection. But ensure they leave the country ASAP

According to the revised law, a law officer cannot approach any legal immigrant and ask for documents unless he is already questioning that person for some other offence
Hence I dont think u need to take the docs to an Ice cream shop, but a copy in the car or something wud suffice logically !!

Hi All,
I need to travel urgently to India due to some family issue and my EAD is expiring in Aug 2010. I need to apply for my renewal before I fly out this Sunday since I will have to be in India for 30 days. Can I e file my application from here and send the supporting documentation by Saturday? If so, I want to make sure that if for some reason, I get a biometrics appt., while in India, how can I postpone it? and also there won't be any issues with my EAD renewal app since I will be India and My I 94 will change once I am back.

-> i guess there is a provision to delay your FP if it arrives for any reason, any of your representative here can scan and let u see the contents , there will be a phone to call and postpone.

Should be out by at latest the 15th... the bulletins in the past have been released in a range between 5th to 15th of the month.

Last time I have showed one copy. They have asked for the second one which I did not take with me.
The POE officer said that USCIS normally sends two copies one for the applicant and one for POE to retain as a proof of entry.
They also said it is ok if we don't take the second one with us.
They just took a copy of the first one and kept it for their records.

Hi,
I got married in 2008, but my wife came with me to the US in Dec 2009. I got married while my I485 was pending due to priority date backlog. I understand that I can add her to my I485 application when my priority dates are current (Jan 17 06). My questions are:
1. How many days do I have to file after my priority dates are current (in case I do get my green card in the interim)?
2. She being a non-Australian born Australian citizen can legally work in this country on a special E3 visa. But I am not sure whether she can be added on my green card application while working on the E3 visa? If thats not possible, the only 2 ways she can work and be added o GC is to apply for H1b (probably not available till October '10) or wait till my priority date is current, file for I485 and EAD and wait for that?
