I am on H1 and my husband on H4.
My 140 is pending.
We recently received EAD for both of us. If my husband applies for SSN but do NOT use EAD or SSN for work . Will he still remain on H4?
I want him to be on h4 status till I get 140 approved.

If your application gets approved before/on 30th June you will get 1 year EAD. If this happens after/on 1st july you should get 2 years. I am in same senario.

It will be Parolee status (AOS Pending) and having AP is important at AOS stage...unless you dont have valid H1B or primary applicant 485 was approved..

I have a PD of April 2008 in the EB2-I category, but am exploring the option of switching to EB1 if possible. I am a clinical psychologist, working in a not-for-profit agency. What are my chances? Does it depend more on the case itself or a really good lawyer who can present your case in the best way it can be presented? This is a really stressful situation because my husband's H1-B runs out next summer and we cannot live here on just my income. Any feedback?

Friends,
I have the following situation, any help/pointers is much appreciated:
- Have EAD (expired Sep 2010). H1B expires Dec 20, 2009.
- I was informed sometime back that I am going to be laid off mid September (next week)
- I am expecting another job offer (interview went well and most likely will get the job) and plan to start at that job late September / eraly October 2009.
- The new offer that I am expecting to get is for the position of Senior Software Engineer, whereas my previous position (where I will be laid off from) was Software Engineer.
So, my questions are:
1. Is it still possible to transfer my H1B visa even though I expect a gap of atleast 2 weeks between the two jobs, or is it better to switch over to the EAD?
2. Will it be a problem for my pending 485 application if my position changes to Senior Software Engr? (although the responsibilities in both positions are about 95% similar, few more responsibilities as a Senior Eng, thats all)
3. If I end up changing over to EAD, what next steps should I do (wrt keeping my 485 applicationb alive and to inform USCIS that I have switched over to EAD).
4. A few months before I got the notice of layoff, I got engaged to a woman in India. I would have preferred to get married by end of the year (would have applied for 1yr extension of H1b) so that my wife could have come over on H4 visa. Now, if I switch over to EAD, what are the options of bringing my (to be) wife over? Is this going to be a problem?

I am planning to apply for NIW based on my HPSA work location.
My attorney is stating that I need to change work contract to 5 years instead of 3 years for the same. According to him, I can add in the contract that this extention of contract is at discretion of employee after 3 years and it will not damage the interests of my employer.
Since I do not want to work after 3 years with my employer, is this contract language safe for me?
Also is it possible to swelf petition for NIW?

I recently got married. My is currently on H1 and is currently in US. Will my wife's I-485 be returned as the priority date is not current I am in EB3 priority date is Mar 2002. Anybody in similar situation as me..please post...
you can not file I-485 for your wife till PD becomes current.
I'm in the same boat. you need to make sure your wife maintains her visa status. Since she is on H1 she should file a labor to make use of 7th year.

Hi all!
I've been trying to get a job offer from Canada for the past one year as my occupation is not on the list of occupations that have shortage. I'm a market research analyst and work online with a UK company for almost 3 years. I would love to move to Canada and have a real job and family but am at a stage where I do not know what else to do as the companies want you to be present in Canada and Canadian govt asks for a job offer to get a visa?
Very confused here. If someone got an arranged offer from Canada could you please guide on how much work experience you had and how you got an offer?

I read the link posted. This is an independent think tank about movement of people worldwide and the report in general analyses the three upcoming bills in relation to EB and non EB immigration and illegals. Overall the bill states that immigration is of benefit to the US and the degree of benefit depends on the legality and skill level of the immigrants, and they suggest that Family category 4 and DV category should be eliminated and used for EB immigration and also suggest readjusting the per country cap to accomadate for the reality of more immigrants from the retrogressed countries. I think this is good and we should include this in our presentation to the lawmakers, this will carry good weight.

tanyas_21: Amendment processing time is same as normal H1 processing time. Your status is H4 until the H1B amendment (797 w/ I-94) is approved or You re-enter USA after you get your H1B stamped. USCIS usually sends cable to home consulate mentioned in I-129 about the approval of H1B - It is one of the reason, most of the attorneys' recommend people to get it stamped from home consulate. As long as you go with all the paper work, You can get it stamped from Mexico, and I dont see any issues. Do not attempt to get it stamped from Canada unless you have a verifiable US education. Good luck!
