I have completed 3.5 years of my H1B and am looking at the possibility of applying for GC either under EB2/3.
After my 12th, I did a 2 year Diploma in Business from Australia and then did a 2 year MA(History) in correspondence (open uni) from India and also a 1 year PGDCA by correspondence.
I have more than 10 years of IT experience to go with my 12+2(fulltime)+3(correspondence)years of education.
Questions:
Please advice if I qualify for EB2 and if so will there be any issues ?

The challenging thing here for your attorney is to provide proof that you have ABET 4-yer bachelor or equivalent degree before filing i-140. Even EB3 is going to be challenging task. Remember H1B requirements are different from EB green card.:(

I have a request / concern / what ever you would say.
Please do not cirtize if you do not like the idea, just ignore and leave the thread.
There are so many people comming to IV for other experts guidance on different things mainly on H1B status, AC21 status, AP, FP, EAD and H4 to EAD, .....
Why don't you create a general guide lines or rules or do's and don't or QA's for each topic, so that each member or visitor who come to IV can atleast go through them before asking or posting quesitons.
You can create a survery for different kinds of questions people / members / visitors might ask or have fore each topic before creating the thread so that we can have a pool of questions and answers for each topic from experts or attorney answered. (you might say we have recordings from attorney Prashanti Reddy, but it would be good if we have some thing which can be referred easily i.e., typed.
These are just some of my thoughts, it can or cannot be implemented. It depeneds on IV admins/Gurus/Experts on this forum.
Gurus, please provide your thoughts.

My husband has been wanting to file a petition under EB-1- EA category. At this point, his credentials are as follows:
1. MS from US university
2. 3 years Job experience in an American Company
3. 14 Paper publications in his masters
4. 2 Patents
And we are still unsure how many papers were cited. He has not written journal papers but may even write few journal papers.
No awards, No member of any jury.
Do you know what chance we may stand in filing under EB-1 and in meeting the 3 requirements in EB-1 Category.
At this point, he can add to his credentials only a few more journals and search for citations.
His company director may be willing to write a letter for him.
Please help us on how to proceed. I do worry a lot in this regard.

Hey Friends,
I got an I-485 interview in next month. I have few questions...
I have the two issues....
1)Selling tobaco to Minor,happened in 2002(when I was helping one of my friend who is running a Convenience store,by mistake I handed Over a pack of cigarett without asking his ID.Unfortunately he was one of the Kid arranged purposefully by the department people who checks on toboco sale to Minors)
2)retail theft happened in 2005(when we went to walmart with our 4 year old daughter,we did not see a considerbly small toy in her hands,while we are making payment to the other stuff we bought)
Both the Incidents occured accidentally,we did not do anything purposefully.Both the cases were dismissed as Nolle proscue. the 2nd case was expunged too .I do have the documents stating that they are dismissed and 2nd case was expunged.If you want to have a look at them,
And also i pointed in I-485 application---No in the field of cases....
can you guys suggest me,if anybody have the similar situvation...

We will be travelling to India and are looking to book Visa appointment. In Mumbai only first week of december is available. As we have to mail the documents, first week of december is not an option for us.

I doubt, it has anything to do with the filing AOS before a certain date. Whatever fee is mentioned on uscis website will apply for everybody.

You have to be "in-status" to apply for AOS. The IO wants evidence of your continued non-immigrant status before you filed your AOS. Also, remember AOS does not grant you a status. It just lets you not accrue unlawful presence

Today, my friend told me that there is new policy prohibiting employees from paying the H1B application fees for their employers. Has someone heard about this policy? If so, would you please provide me some more details on the issue? Where could I find the policy?
I have got two offers. Both the employers are willing to help me apply for H1B, but I need to pay all the fees by myself. I think that is ok for me. But under this new policy, I am not sure whether this strategy would work out or not. I really very worry about this issue. Your kindly help is highly appreciated!! Million thanks!

My case was approved by BEC on July 18. My attorney says that my 140 has to be filed by July 31 to be eligible to file under July visa bulletin [by 17th August]
Is his interpretation correct?
I can not do concurrent for a few more days, until my family returns from India.
If I go with 140 now, I am afraid the 140 receipt may not arrive in time for me to file for 485.

You should speak to an immigration attorney. That's the best I can tell. False claiming to be a U.S. Citizen can lead to a permanent inadmissibility to the US. As such, it is a serious matter and should be discussed with an attorney.

Just hold on to those papers and make them available when they travel back in future.
Their Visa will not get cancelled, i have seen people coming back second time after just rejection. But ensure they leave the country ASAP
